Apex Systems Forces Some Recruiters to Arbitrate Overtime Claims

A national staffing agency convinced a federal judge in Richmond to enforce arbitration agreements against 92 of more than 200 recruiters who opted into a Fair Labor Standards Act overtime collective action.

Apex hasn’t waived arbitration through its litigation conduct and may enforce the valid arbitration agreements against 92 recruiters who signed them, Judge John A. Gibney of the U.S. District Court for the Eastern District of Virginia said Tuesday. The court granted Apex’s motion to compel and dismiss those plaintiffs’ claims.
