Appraiser’s Smelly Car Job Bias Suit Not Proper Against County

Spotsylvania County, Va., won’t face a commercial property appraiser’s job bias lawsuit stemming from a mysterious odor in his county-issued car, including claims he was denied accommodation for his ensuing disability and fired for his repeated complaints, a federal judge ruled.

Kevin Butler can’t sue the county under the Americans with Disabilities Act and Title VII of the 1964 Civil Rights Act because it wasn’t his “employer” or “joint employer” under either law, the U.S. District Court for the Eastern District of Virginia said Thursday.
