Au Pair Agency Must Face Childcare Workers’ Minimum Wage Claims

A group of childcare workers may advance federal and state wage claims against Cultural Care Inc., an au pair agency that participates in the State Department’s J-1 cultural exchange visa program, a Massachusetts federal court ruled.

The workers put forth enough facts about their average hourly wages and their work to plausibly allege the existence of an employment relationship and minimum wage violations, Judge Richard G. Stearns of the U.S. District Court for the District of Massachusetts said Wednesday.
