California Staffing Agencies Defeat Race Discrimination Claims

Two California staffing agencies aren’t liable for allegedly discriminating against two black employees who didn’t get promoted because they were “leased” to the company who declined to advance them and it had all the authority over those decisions, a state appeals court affirmed.

Bonnie Ducksworth and Pamela Pollock are customer service representatives at Tri-Modal Distribution Services, a transportation logistics, warehousing, and distribution services company, and both applied for the position through Scotts Labor Leasing Company. Pacific Leasing Inc. was leasing Ducksworth to Tri-Modal at the time of the complaint, Scotts was doing the same for Pollock.
