Canadian Pacific Worker Lacks Proof of Sex, Leave Bias in Layoff

A Canadian Pacific Railway operations supervisor failed to show she was included in a 2016 workforce reduction because she is a woman and took medical leave, not because of her relative qualifications, the Eighth Circuit ruled Tuesday.

Dakota, Minnesota & Eastern Railroad Corp., which does business as Canadian Pacific, decided to eliminate the Missouri desk of its Southern dispatching region and redistribute the desk’s duties to its Kansas City desk, where Rhonda Button worked, and its Iowa desk, the court said.
