A pharmaceutical sales representative with a serious eye condition that prevented him from driving should’ve been granted a trial on his claim that the company violated the Fair Employment and Housing Act when it fired him, even if the discharge was based on an honest, but mistaken, interpretation of the company’s disability accommodation policy. A temporary corporate benefits staffer incorrectly thought that the representative was totally disabled and that the fact that he became eligible to transition from short-term disability benefits to long-term benefits required his discharge if he was still unable to work even with a reasonable accommodation.
