Case: Disability/Employer Coverage (E.D. La.)

An HIV positive employee for a hospitality company in Louisiana may not proceed with his claim that he was fired because of his disability, rather than for abandoning his job. The company wasn’t a covered employer under the Americans with Disabilities Act because it lacked 15 employees for the requisite time period during the employee’s tenure, and he didn’t provide sufficient evidence to support his allegation that it was an integrated enterprise made up of multiple, superficially distinct entities that may have contained the threshold number of employees during the relevant time period.
