An Iran-born American engineer for Shell Expatriate Employment US Inc. in Texas may not proceed with his claim that he was fired because of his national origin, rather than for unsatisfactory work performance and failing to “repatriate” to the United States after working in the Miri, Malaysia office. Shell gave him three months to repatriate and offered to help book his trip back, but he failed to return to the United States within that time-frame even though he knew that he could be fired if he didn’t do so.
