A pharmacist for a hospital in Massachusetts may proceed with her claim that she was fired in retaliation for taking leave under the Family and Medical Leave Act, instead of for failing to comply with its policies. Questions remain about whether or not her FMLA leave was the actual reason for her termination, because she alleged that although others failed to follow policies, she was the only one who was actually fired for noncompliance. The case is Gudava v. Northeast Hosp. Corp., 2020 BL 53174, D. Mass., No. 17-12414-NMG, 2/13/20.
