A “response to intervention teacher” for Falmouth Public Schools in Maine may not proceed with her claim that she was fired in retaliation for taking leave under the Family and Medical Leave Act, instead of for performance-related issues, the District of Maine held. The decision-maker supported her FMLA leave, she was the only one terminated out of 19 employees who had taken FMLA leave in a three-year period, and she didn’t provide any other evidence that suggested that Falmouth acted in a retaliatory manner.
