Chicago Officer Can Sue Based on Speech in Laquan McDonald Case

The city of Chicago must face a police lieutenant’s claims he wasn’t promoted to captain because he is Latino and made statements regarding the city’s fault in the shooting death of Laquan McDonald, the Northern District of Illinois ruled.

Osvaldo Valdez’s lawsuit under 42 U.S.C. Section 1983 includes enough detail to state plausible claims against the city for violations of his right to be free from race discrimination under the equal protection clause and for free-speech retaliation under the First Amendment, the court said Thursday.
