Chipotle Must Face Trial on Claim It Fired Worker Because of IBS

A trial is needed to determine whether Chipotle Services LLC discriminated based on disability when it fired an employee who missed several days of work because of his irritable bowel syndrome, the U.S. District Court for the District of Oregon ruled.

The Chipotle Mexican Grill Inc. subsidiary asserted a nondiscriminatory reason for terminating Justin Melani by pointing to his past performance issues, the court said. But supervisor Stephen Short had told Melani shortly before his IBS flared up that the performance of both Melani and his restaurant had improved, the court said Jan. 21.
