Coal Company Lawsuits Target Safety Bonus Program Standard

Ten coal companies want a federal appeals court to review a legal standard the secretary of labor used to determine that financial bonus programs tied to miners’ safety are an unlawful interference in protected activity.

If a court finds in favor of the federal government, coal companies could be left in limbo when it comes to how they offer financial bonuses to workers on the basis of safety in the future, Brian Hendrix, a member of Husch Blackwell LLP’s Energy & Natural Resources group in Washington, told Bloomberg Environment.
