Fluor Arm Must Face Trial on Muslim Worker’s Retaliation Claims

An Iraq-born Muslim employee’s evidence could convince a jury that Fluor Federal Services LLC put her on a performance improvement plan and then fired her for complaining about national origin and religious discrimination, the District of South Carolina ruled.

The Flour Corp. subsidiary says it placed Inam Naji on the two-month PIP because of her pattern of not completing her assigned job duties. And it terminated Naji because of her work errors, failure to meet her weekly goals, and co-workers being forced to complete her work for her, according to the company.

Those are legitimate, nonretaliatory justifications under Title VII...
