NLRB Prohibits Mail Ballot Solicitation in Union Elections (1)

Soliciting ballots in a mail-in union election is objectionable conduct that can lead to the vote results being thrown out, the National Labor Relations Board said in a decision that will have an impact on union elections during and after the pandemic.

The NLRB said Wednesday that election results would be set aside if the solicitation affected enough votes to determine the outcome. Ballot solicitation in union elections typically occurs when a union or an employer asks a worker for his or her ballot with the promise of mailing it. The board previously barred the collection of mail ballots.
