Coal Company Sues Over Mercury Rule as EPA Guts Legal Rationale

A coal company is taking aim at federal restrictions on mercury pollution from power plants after the EPA scrapped the legal rationale for the standards.

Westmoreland Mining Holdings LLC filed a petition for review Friday in the U.S. Court of Appeals for the District of Columbia Circuit, asking the court to review the legality of the 2012 mercury and air toxics standards, or MATS, along with related agency decisions.

The case isn’t yet docketed, but attorneys for Englewood, Colo.-based Westmoreland confirmed it was filed Friday.
