DuPont Opposes Joint Trial of Plaintiffs’ Teflon Injury Claims

DuPont would be unfairly prejudiced if the court overseeing suits alleging a toxic Teflon component contaminated drinking water in Ohio and West Virginia allows the claims of two plaintiffs suffering from different diseases to be tried together, the company argued.

The suits allege DuPont caused neighbors to develop cancer and other diseases by knowingly dumping perfluorooctanoic acid (PFOA), also known as C-8, into local waterways.

The trial court erred in consolidating the trials of Travis Abbott and Angela Swartz because they were diagnosed and treated for different types of cancer, DuPont told the court Nov. 15.
