EPA Must Face Negligence Claims Over Gold King Mine Spill

New Mexico, Utah, and the Navajo Nation may proceed with hazardous waste claims against the federal government stemming from the 2015 Gold King Mine spill, the District of New Mexico ruled.

The government isn’t immune from allegations that EPA workers and contractors triggered the release of millions of gallons of mining wastewater and toxic sediment from the mine into the Animas River watershed, the court said.

The Environmental Protection Agency triggered the spill while opening a passage leading into the mine to identify actions needed to address contamination flowing from the site.
