California Hospital Gets New Chance to Fight State Agency Fine

California’s Saint Francis Memorial Hospital is on track to get another chance to dispute a $50,000 state fine for allegedly failing to develop and implement a medical procedure, after the state’s top court said its challenge may be timely.

The hospital missed the original deadline for appealing the California Department of Health’s decision, but has met most of the requirements for “equitable tolling” of the statute of limitations, the California Supreme Court said Monday.

Equitable tolling halts the time period for bringing an action or appeal when it would be unfair to strictly apply a limitations period.
