Patient’s Claim for Disclosure of Medical Records Proceeds

An Indiana health-system whose employee disclosed a patient’s medical information to her husband, who happened to be the patient’s employer, must answer the patient’s breach of confidentiality claims, an Indiana state court said.

Under Indiana law, health-care providers owe patients a common-law duty to protect the confidentiality of their private health information, the Indiana Court of Appeals said Oct. 8. Where there is a duty, a cause of action exists for its breach, the court said.
