Sanofi Wins Judgment in Taxotere Case, Avoids Second Test Trial

A woman linking the breast cancer drug Taxotere to permanent hair loss waited too long before suing manufacturer Sanofi-Aventis US LLC, a federal trial court in Louisiana said.

Cynthia Thibodeaux’s suit filed in 2016 needed to be filed by January 2011, the U.S. District Court for the Eastern District of Louisiana said. She isn’t entitled to a discovery rule that suspends limitations because she didn’t investigate whether she had a legal claim even though she suspected her hair was taking too long to regrow, it said.

The suit would have been the second test trial in federal multidistrict litigation...
