Texas Sues HHS to Hold on to $25 Million in Medicaid Payments (1)

Texas’s health commission is suing the U.S. Health and Human Services Department in federal court to overturn a decision requiring it to repay the federal government over $25 million in supplemental Medicaid payments it paid to private hospitals.

The HHS used standards that were inconsistent with established regulations and practices regarding provider-related donations when it determined the Texas Health and Human Services Commission improperly made uncompensated care payments to private hospitals in Dallas and Tarrant counties in 2015, the commission said in a complaint filed in the U.S. District Court for the Northern District of Texas Dec. 2.
