Wisconsin Businesses’ Suit to Stop Covid-19 Data Release Fails

Three Wisconsin trade associations lost a bid to stop the state’s health department from publicly releasing the names of businesses that have had two or more employees test positive for Covid-19, as the associations don’t have a protectable interest in keeping the data private, a state appeals court said.

Wisconsin’s health data privacy laws don’t provide the associations with standing to bring a declaratory judgment action challenging the state’s planned release of the information because only an individual may sue for violations of the laws, the Wisconsin Court of Appeals, District IV, said.
