Ex-Food Worker Fights to Keep Biometric Privacy Lawsuit Alive

A former sanitation and assembly line worker at a food manufacturer is fighting back against the company’s argument that the Biometric Information Privacy Act doesn’t apply to his claims of improper handprint collection.

Eagle Family Foods Group LLC is the former employer of plaintiff Gregory Gates, but BIPA would apply even if Gates were a third-party worker and not employed directly by the company, attorneys representing Gates argued in a response filed Monday in the U.S. District Court for the Northern District of Illinois.

Attorneys representing Eagle Foods didn’t immediately respond to a request for comment.
