T-Mobile Call Center Workers Earn Collective Status in Wage Suit

A group of T-Mobile customer-service representatives may proceed as a nationwide Fair Labor Standards Act collective on claims that they weren’t paid for off-the-clock work, a Washington federal court ruled.

The plaintiffs’ declarations, along with job postings from four different call centers, sufficiently establish that T-Mobile likely subjected other employees to the same compensation policies and practices, Judge Robert S. Lasnik of the U.S. District Court for the Western District of Washington said Tuesday.

But the court found that T-Mobile sufficiently refuted claims that it miscalculated overtime pay and declined to certify a collective on those claims.
