Donghee Didn’t Infringe Fuel Tank-Making Patents, Court Says (1)

Donghee America Inc.'s process for manufacturing fuel tanks doesn’t infringe another company’s patents because it lacks the patented “parison” and other overlapping plastic cutting techniques, the Federal Circuit said in an opinion unsealed Dec. 3.

Plastic Omnium Advanced Innovation & Research owns U.S. Patent Nos. 6,814,921 and 6,866,812, related to manufacturing plastic fuel tanks in a way that allows accessories to be installed inside without cutting holes in the tank wall. The District of Delaware granted Donghee summary judgment of noninfringement, and the appeals court agreed.
