The National Rifle Association defeated a bid to dismiss its claim that an advertising agency violated federal law by continuing to use its name and images on its website after their association ended, according to a Texas federal court ruling.
Ackerman McQueen Inc.'s motion to dismiss the NRA’s Lanham Act claim was denied because the gun rights organization both sufficiently pleaded it falls within the zone of interest protected by the statue and that the agency’s website is misleading, Judge Joe Fish of the U.S. District Court for the Northern District of Texas said.
