Pennsylvania Bank Robbery Convictions Upheld by Third Circuit

The convictions of two men for robbing two banks in Pennsylvania will stand despite their assertion that their counsel made a tactical decision that violated their constitutional right to put on a defense of their choice, the Third Circuit said.

Defendants Marquis Wilson and Malcolm Moore weren’t deprived of their Sixth Amendment rights because of counsel’s decision to stipulate to the fact that they were accused of robbing a federally insured bank and could therefore be charged with federal bank robbery, the U.S. Court of Appeals for the Third Circuit said Friday in a matter of first impression.
