Virginia Inmate’s Suit Revived Over Lack of Showers, Recreation

An inmate in Virginia’s Red Onion Prison is entitled to go to trial on civil rights claims alleging correctional officers denied him showers and recreation while in solitary confinement, the Fourth Circuit said Nov. 19.

The prison’s policy deprived Denis A. Rivera of a meaningful opportunity to wash and exercise because he was often asleep when officials sought the required verbal requests, the U.S. Court of Appeals for the Fourth Circuit said in an unpublished per curiam opinion.
